Introduction to Cohort (2):

Welcome to the Comprehensive Environmental Law Training Program, designed to provide a thorough understanding of environmental legal frameworks, principles, and practices. This program is tailored to equip participants with the knowledge and skills needed to navigate the complex landscape of environmental law, compliance, and dispute resolution.

Throughout this training, participants will embark on a comprehensive exploration, starting with fundamental modules such as an introduction to environmental law concepts and the foundational principles that guide its application. We will delve into the intricacies of Kenyan environmental legislation, dissecting the constitutional framework and sectoral regulations governing biodiversity, wildlife, water, and more.

As we progress, the program unravels the procedural dimensions in the adjudication of environmental disputes and highlights critical subject areas, including environmental crimes, human rights, and climate justice. Participants will gain insights into the enforcement of environmental rights, understanding the linkages between human rights and environmental protection, and exploring avenues for litigation in pursuit of environmental justice.

Course Objectives for Cohort (2):

By the end of this course, attendees will be able to:

  • Identify and analyze threats to environmental integrity, with a focus on the Kenyan context.
  • Examine key principles of environmental law, including preventive action, precautionary principles, and sustainability.
  • Examine sectoral legislation related to biodiversity conservation, wildlife, water, wetlands, noise, air quality, cultural and natural heritage, climate change, toxic substances, and waste.
  • Discuss case management specific to environmental matters.
  • Investigate environmental crimes, human rights, land use, water rights, and ESIA.Analyze challenges associated with environmental adjudication.
  • Explore international instruments supporting the right to a healthy environment.
  • Understand the role of litigation in realizing environmental justice.
  • Conceptualize climate justice and its principles.
  • Explore legal frameworks at international, regional, and national levels.
  • Understand international environmental problems and the development of international environmental law.
  • Review international and regional instruments Kenya has signed.
  • Link ADR to environmental disputes and examine its procedural aspects.
  • Understand consequences of non-compliance with international conventions and obligations.

Course Outline for Cohort (2):

Module 1: General Introduction to Environmental Law

In this module, we delve into the fundamental aspects of Environmental Law, exploring the concept of Environment Management and the Law. Additionally, we scrutinize the specific threats to Environmental Integrity in Kenya.

Module II: Foundations of Environmental Law

This module focuses on laying the groundwork for understanding Environmental Law. Furthermore, we examine the key principles that underpin Environmental Law. Additionally, we explore Common Law Principles of Environmental Law.

Module III: Overview of Kenyan Environmental Legislation

Moving forward, we provide an overview of the relevant Kenyan Environmental Legislation. This includes an in-depth examination of the Constitution of Kenya, 2010, which sets the constitutional framework for environmental governance. We also explore the Framework Legislation of Environmental Law, particularly the Environment (Management and Coordination) Act (EMCA) as amended.

Module IV: Procedural Aspects in Adjudication of Environmental Disputes

In this module, we explore the procedural dimensions involved in the adjudication of environmental disputes. Additionally, we scrutinize the types of evidence used in environmental cases and discuss the range of remedies and sanctions applicable.

Module V: Principle Subject Areas of Environmental Adjudication

Moving forward, this module focuses on the core subject areas within environmental adjudication. We explore Human rights, and the environment are examined, highlighting the intersection between legal rights and environmental considerations.

Module VI: Enforcement of Environmental Rights

This module establishes the connections between human rights and the environment, exploring international instruments that recognize the right to a healthy environment.

Module VII: Climate Justice

In this module, we delve into the complex and critical realm of Climate Justice. We commence with an exploration of Climate Change, defining its causes and consequences. The module also explores the role of the legal profession in promoting Climate Justice in Kenya, including Climate Change Litigation.

Module VIII: Implementing International Environmental Law in Kenya

The final module focuses on the implementation of international environmental law within the Kenyan context.

Module X: Alternative Dispute Resolution (ADR) in Environmental Law

Delve into the realm of Alternative Dispute Resolution (ADR) and its application in the context of Environmental Law. Additionally, we delve into the procedural aspects of ADR specific to environmental disputes and discuss the challenges associated with applying ADR in Environmental Law Disputes.

Module XI: Environmental Compliance and Enforcement

Module XI focuses on the critical aspects of Environmental Compliance and Enforcement. The module commences with an examination of Environmental Compliance, emphasizing the importance of adhering to environmental regulations. The module concludes with insights into the preparation of environmental offense case files, providing a comprehensive understanding of the enforcement mechanisms in place.
